Developer ResourcesDevelopers are often faced with many questions regarding how their projects will impact wetlands, and what actions are necessary to comply with wetland regulations. The following links are presented to aid in the navigation of some of the issues developers may deal with, including permitting, water quality certification, water quality standards, and restoration. Under Section 404 of the Clean Water Act, consideration must be given to the impact of a construction project on wetlands. Impacts should be avoided or minimized where practicable.Where impacts cannot be avoided, permitting and compensatory wetland mitigation may be necessary. For more information about 404 Permitting, please see 404 Permitting. Any activity where dredge or fill material is discharged into a Water of the United States is subject a 401 Certification review. For more information, please see 401 Certification. Developers may be required to conduct restoration to offset the impacts to wetlands from construction projects. Stormwater and treatment wetlands The Oklahoma Wetlands Technical Work Group is working to develop guidelines to make treatment wetlands a viable option in the future. Wetland water quality standards The Oklahoma Wetlands Technical Work Group is currently working to develop water quality standards designed specifically for wetlands. In Oklahoma, there are currently no formally accepted assessment tools for use with 404 mitigation or to support Water Quality Standards.
