1.  How do I get a copy of my crash report?

Crash reports are maintained by Records Management under the Oklahoma Department of Public Safety. The methods for receiving a copy of your crash report can be found here.

You can register for a DataQ account on the Federal Motor Carrier Safety Administration (FMCSA) website here. Once registered, you will file a DataQ request under Crash then select the appropriate issue. *Please be aware that most crash reports are not generated from Troop S - Commercial Vehicle Enforcement, but from other law enforcement agencies.

Driver

If a driver does any prohibited conduct found in 49 CFR 382.201 through 382.215, does the motor carrier have to retain the driver?

1.  If a driver does any prohibited conduct found in 49 CFR 382.201 through 382.215, does the motor carrier have to retain the driver?

A driver who violates 49 CFR 382.201 through 382.215 becomes unqualified as a driver. The decision to terminate an unqualified, or any driver is at the motor carrier's discretion. The motor carrier is not required by the Federal Motor Carrier Safety Regulations to terminate or retain any driver, but may be bound by their company policy, employment contracts, collective bargaining agreements or other legal requirements, therefore the carrier should consult with their professional legal counsel. If the motor carrier terminates the driver for any violation of 49 CFR 382.201 through 382.215, the motor carrier is required to inform the driver of the violation, remove them from all safety-sensitive functions and refer the driver to a Substance Abuse Professional (SAP).

2.  If a driver does any of the prohibited conduct found in 49 CFR 382.201 through 382.215 and is now unqualified, how do they become qualified again?

There is a process the carrier must follow in order to retain the driver which is found in 49 CFR Part 40 and 49 CFR Part 382. As a guide, Troop S has summarized the steps involved when a driver has committed any of the prohibited conduct to assist the motor carrier with the process. Keep in mind this is only a guide and summary of the regulations. It is the responsibility of the motor carrier to ensure that all requirements regarding the Substance Abuse Professional (SAP) evaluation and return to duty process are met and should refer to 49 CFR Part 40 and Part 382.

The Federal Motor Carrier Safety Regulations do not address the financial responsibility for this process. The motor carrier may be bound by their company policy, employment contracts, collective bargaining agreements or other legal requirements, therefore the carrier should consult with their professional legal counsel.

3.  Is a roadside Driver/Vehicle Examination Report a ticket?

No. However, Oklahoma does assess a civil penalty for out-of-service violations discovered during a roadside inspection. This penalty is generally mailed to the company 3-6 weeks after the date of the roadside inspection. (You can obtain a copy of the current North American Out-of-Service Criteria here.)

5.  What do I need to do with my Driver/Vehicle Examination (inspection) Report? What is a Carrier Certification?

Every time our Troopers stop a CMV, the Trooper prints two copies of the inspection. One for the Trooper to turn in to Troop S; and one for the driver to take back to the carrier/company.

The inspection needs to be signed by a mechanic who repaired any mechanical defects (if applicable) and/or a representative of the company. The signature is certifying the company has taken the necessary steps to address the violations discovered. So the next time they are stopped, those violations should not be present.

The company should then return that inspection to Troop S by fax: (405) 702-0819 or mail: Oklahoma Highway Patrol - Troop S, 200 NE 38th Terrace, Oklahoma City, OK 73105. We also recommend that you keep a copy for your records.

*Note - a Level I inspection with no violations found can serve as the annual inspection required for that vehicle.

6.  What is a CVSA decal?

The North American Standard Level I and/or Level V are the only inspections that may result in issuance of a Commercial Vehicle Safety Alliance (CVSA) decal. To qualify for a CVSA decal, a vehicle must not have any violations of the items contained in the CVSA operational policy and North American Standard Out-of Service Criteria.

Inspections must be performed by and CVSA decals affixed by North American Standard Level I and/or Level V certified inspectors. The term "certified" as used in this section means the government employee performing inspections and/or affixing CVSA decals must have first successfully completed a training program approved by the Alliance. CVSA decals, when affixed, shall remain valid for a period not to exceed three consecutive months. Vehicles displaying a valid CVSA decal generally will not be subject to re-inspection.

However, nothing shall prevent re-inspection of a vehicle or combination of vehicles bearing valid CVSA decals, under the conditions specified in the section titled, "Re-inspection". For more detailed information on CVSA decals please visit the Alliance's website here.

1.  If I receive a Notice of Claim (Civil Assessment Penalty) letter in the mail, what can I do to dispute it?

You can request an administrative hearing which is performed via a telephone hearing. If you wish to dispute only the amount of the civil penalty and/or the length of time to pay, you can select to have our staff review your request through Troop S' settlement agreement program. The request forms can be found here.

These can only be done within the first 25 days of the date on the First Notice of Claim.

You can pay two ways.

You can mail a check to Oklahoma Highway Patrol - Troop S, 200 NE 21st St, Oklahoma City, OK 73105. Please include the Examination Report number on your check.

You can also pay online here. You will need to have the Examination Report number.
