The proposed emergency rules implement legislative changes mandated by Senate Bill 1704 and address changes in statute under 63 O.S. �§ 427.14b. The emergency rules govern proceedings before the agency, including provisions regarding appeal of adverse credential determinations. The rules are intended to ensure consistent process is afforded to both the Agency as well as credential applicants and commercial licensees. Permanent rules implementing the requirements set forth in the new legislation cannot be promulgated until 2024.

The proposed emergency rules are required pursuant to the effect of Senate Bill 1704 and because these rules are only for implementation of an existing statutory mandate there is no anticipated impact of these rules. The agency does not expect a notable impact on businesses or patients due to these proposed emergency rules. There are no classes of persons that will benefit from the proposed rules. Due to the previously stated fact that these rules are for implementation of an existing statutory mandate, the proposed emergency rules are not expected to have an economic impact, cost of compliance, or fee changes. There is not expected to be an impact on political subdivisions from these rules. There are no expected adverse effects on small businesses from these rules. The agency has endeavored to ensure these proposed emergency rules are limited to the requirements outlined in state statute so as to minimize the impact and costs of these proposed rules. These proposed emergency rules will preserve the Agencyâ??s core functions to protect the health and safety of all licensees. There are no identifiable detrimental effects on public health and safety.
