NOTICE OF PUBLIC HEARINGS
The Oklahoma Department of Mines (ODM) is conducting Public Hearings for discussion of the 2014 proposed rule changes as follows:
December 18, 2013, @ 2:00 p.m. through 3:15 p.m., ODM Office, 2915 N. Classen Blvd., Ste. 213, Oklahoma City, OK
December 18, 2013, @ 6:00 p.m. through 7:15 p.m., Wagoner Field Office (WFO), 1102 W. Cherokee, Ste., D, Wagoner, OK
Proposed changes involve:
Chapter 1. Oklahoma Mining Commission: adding notification requirements for outside instructors who train surface supervisor re-certification courses and requiring record truthfulness.
Chapter 2. Rules of Practice and Procedure for Coal Reclamation Act of 1979: correcting OKC Office address and replacing the Chief Mine Inspector title with the Director title.
Chapter 3. Non-Coal Rules of Practice and Procedure: Replacement of Chief Mine Inspector title with Director title; OKC address change and petition publication change from Oklahoma Gazette to Daily Oklahoman and Tulsa World.
Chapter 10. Non-Coal Rules and Regulations: OKC address changes; replacements of Chief Mine Inspector title with Director title and petition publication changed from Oklahoma Gazette to Daily Oklahoman and Tulsa World; Subchapter 13, additions: definitions of Sensitive basins, Management plans and Pit water and Sensitive basin permitting and operational requirements; Subchapter 31 addition of certified surface blaster qualifications; correction of several typographical and grammatical errors.
Chapter 15. Underground Coal and Asphalt: Additions to Subchapter 15: requiring applications to describe legal right to enter and provide said copy; requiring a certified superintendent on every shift, requiring man doors every 600 feet. No combustible materials within 300 feet of openings.
Chapter 25. Oklahoma Explosives and Blasting Regulations: OKC address changes; deletion of application deadline and allowing digital & video shot recordings with required recording information.
Chapter 20. The Permanent Regulations Governing the Coal Reclamation Act of 1979: Numerous OKC address changes and replacements of Chief Mine Inspector title with the Director title; addition of tag lines; Subchapter 15 deletes language and adds ODM requirements to permitting; Subchapter 29 adds GPS inclusion and depth to be mined to mapping requirements; Subchapter 43 additions made to: topsoil removal requirements, requirements of data for blasting records, annual reporting requirements for contemporaneous reclamation and qualifications for temporary cessation and the term allowed; Subchapter 45: 460:20-45-5 a( c) adding temporary casting and sealing underground openings; 460:20-47-4 a (d) requiring surface drainage to be directed away from the highwall.
