How Can I Review Coal Mining Permit & Revision Applications? Where Can I Get More Information About |

One of the major purposes of this website is to provide citizens with information about mines and mining that affects them directly. You can find lists of current mines being inspected, their location, their identifying permit number, size, and associated violations. We are continually adding information as public needs become known. If you want information on a particular coal mining permit or revision application or any issued coal mining permit or revision, you may contact the Wagoner Field Office at 918-485-3999. If you'd like to view a coal permit or revision document you may visit our Oklahoma City office and review the public file located there. Or you may make an appointment to view the permit or revision in question at one of our field offices (Wagoner, McAlester, and Poteau.) The appointment is necessary in order to make sure that the permit or revision you want to view is available at a particular office on a certain date and time. If you can not travel to a field office or the Oklahoma City office, contact the Wagoner Field Office and we will make arrangements to bring the materials to you for review at public building near your location. |
The Coal Mining Company is Required to Advertise and File a Copy of the Permit or Revision Application in a Courthouse in the County Where Mining Will Occur. |

Coal Permits and Revisions: Newspaper Advertisements by Applicants OAC 460:20-15-5 (a) Public participation in permit processing - (1) Upon submission of an administratively complete application, an applicant for a permit, significant revision or a permit under Section 460:20-17-3, or renewal of a permit under Section 460:20-17-4, shall place an advertisement in a local newspaper of general circulation in the locality of the proposed surface coal mining and reclamation operation at least once a week for 4 consecutive weeks. A copy of the advertisement as it will appear in the newspaper shall be submitted to the Department. The advertisement shall contain, at a minimum, the following: (A) The name and business address of the applicant. (B) A map or description which clearly shows or describes the precise location and boundaries of the proposed permit area and is sufficient to enable local residents to readily identify the proposed permit area....(C) The location where a copy of the application is available for public inspection. (D) The name and address of the Department where written comments, objections, or requests for informal conferences on the application may be submitted .... |

Coal Permits and Revisions: Copies to be Filed in County Courthouse by Applicants OAC 460:20-15-5 (a) Public participation in permit processing - (2) The applicant shall make an application for a permit, significant revision under Section 460:20-17-3, or renewal of a permit under Section 460:20-17-4 available for the public to inspect and copy by filing a full copy of the application with the recorder at the courthouse of the county where the mining is proposed to occur, or an accessible public office approved by the Department. The copy of the application need not include confidential information exempt from disclosure under Subsection (d) of this Section. The application required by this Subsection shall be filed by the first date of newspaper advertisement of the application. The applicant shall file any changes to the application with the public office at the same time the change is submitted to the Department. |
Please notify the Wagoner Field Office at 918-485-3999 if you visit the Courthouse listed in the advertisement and do not find the documents described. For many reasons, some beyond the companies' control, documents go missing. If we are aware of the problem, we will require the company to replace those documents. |
