HEALTH CARE INFORMATION ADVISORY COMMITTEE

BYLAWS

 

PURPOSE
The purpose of the Health Care Information Advisory Committee is to advise and assist the Oklahoma State Department of Health, Division of Health Care Information with determinations related to the Division's charge associated with the Oklahoma Health Care Information Act, 63 O.S. (Supp. 1994)
1-115 et seq.

FUNCTION
The duties and responsibilities of the Health Care Information Advisory Committee (herein referred to as the Advisory Committee) shall be:

  1. To provide input and advice to the Division of Health Care Information (Division) on the collection of health care information from information providers, including the format for the collection of data elements, the frequency of reporting, and outreach activities to encourage reporting by information providers.
  2. To advise and assist the Division with the determination of reports to be generated from the Health Care Information System database that will provide timely and useful information for information providers, public health agencies, other state agencies, the Oklahoma State Legislature, academic health centers and the general public.
  3. To advise the Division on matters relating to confidentiality issues and protocols for the release and dissemination of information from the Health Care Information System database.
  4. To advise and assist the Division with the development of a five-year plan to fully implement the provisions of the Oklahoma Health Care Information Act and to create a comprehensive integrated health care database for the State of Oklahoma.
  5. To review and comment on proposal rules for adoption by the State Board of Health governing the acquisition, compilation and dissemination of all data collected pursuant to the Oklahoma Health Care Information System Act.

TITLE
The Advisory Committee shall be known as the Health Care Information Advisory Committee.

MEMBERSHIP
Membership of the Health Care Information Advisory Committee shall be composed of 35 voting members. Members shall be appointed by the Commissioner of Health as specified in the Oklahoma Health Care Information System Act on or before December 15, 1998, and shall include:

  1. Administrator of the Oklahoma Health Care Authority;
  2. President of the Oklahoma State Chamber of Commerce;
  3. President of the Oklahoma Hospital Association;
  4. President of the Oklahoma State Medical Association;
  5. President of the Oklahoma Osteopathic Association;
  6. President of the Oklahoma AFL-CIO;
  7. President of the statewide health care consumer coalition;
  8. President of the Association of Oklahoma Life Insurance Companies;
  9. President of the Oklahoma Health Care Association;
  10. President of the Oklahoma Pharmaceutical Association;
  11. President of the Oklahoma Dental Association;
  12. President of the Oklahoma State Chiropractic Association;
  13. President of the Optometry Association;
  14. President of the Oklahoma Physical Therapy Association;
  15. President of the Oklahoma Podiatry Medical Association;
  16. President of the Oklahoma Psychological Association; and
  17. President of the Oklahoma Association of Home Care.


These organizational members may appoint designees to serve on the Advisory Committee.

The Commissioner of Health will appoint an additional 18 Advisory Committee members to serve 2 to 3 year terms as requested. These members will include, but not be limited to, representatives of hospital systems, hospitals, physicians, academic health centers, managed care organizations, and public health agencies.

Members of the Advisory Committee shall not receive a salary, but non-governmental appointees shall be allowed reimbursement for expenses pursuant to the State Travel Reimbursement Act.

OFFICERS
Officers of the Health Care Information Advisory Committee shall be the Chairperson and the Vice Chairperson. The Commissioner of Health shall appoint the Chairperson and Vice Chairperson to serve for a one or two year term, at his/her discretion.

The Chairperson shall be the Principal Officer of the Health Care Information Advisory Committee. He/she shall preside at all meetings. He/she may sign all correspondence as maybe authorized by the Advisory Committee. He/she shall perform all other duties incident to the Office of Chairperson as prescribed by the Advisory Committee. In the absence of the Chairperson, or in the event of the Chairperson's inability to serve, the Vice Chairperson shall be empowered to perform duties of the Chairperson.

SUBCOMMITTEES
The Chairperson, with the input of the Division, shall be empowered to appoint Subcommittees as may be necessary to advise the Advisory Committee on technical matters dealing with the collection, dissemination and confidentiality of the data. The Chairperson, with the input of the Division shall, appoint the Chairperson of each Subcommittee.

MEETINGS
The Advisory Committee shall hold regular meetings at least once a year or at the call of the Chairperson. Subcommittees shall meet at least three times per year and report specific technical recommendations to the Advisory Committee.

Eighteen members of the Advisory Committee shall constitute a quorum to transact business, but no vacancy shall impair the right of the remaining members to perform the duties and responsibility of the Advisory Council.

Members shall give prior notice to the Health Care Information Division when they are not able to attend a meeting.

No member of the Advisory Committee may participate in or seek to influence a decision or vote of the Advisory Committee if the member would derive income or be directly involved with the issue.

Proxy voting shall not be permitted. Committee members may send alternates to meetings.

The Division shall provide staff support for all meetings of the Advisory Committee and shall be responsible for meeting arrangement and taking minutes. Minutes will be summaries of the agenda items with availability of the taped minutes accessible to all members. The Division shall also be responsible for disseminating correspondence and other information regarding Advisory Committee business.

All meetings of the Advisory Committee shall be in accordance with regulations of the Oklahoma Open Meeting Act and shall be open to the public.

PARLIAMENTARY AUTHORITY
The rules contained in the current edition of Robert's Rule of Order, Newly Revised shall govern the Advisory Committee in all cases to which they are applicable.

STANDING RULE
The Advisory Committee shall provide information and assistance to any legislative committee or task force requesting such information or assistance as authorized by the Oklahoma Health Care Information System Act.
