Facebook

The National Association of Attorneys General (NAAG) and the National Association of State Chief Information Officers (NASCIO) have negotiated an amendment to the Facebook Page Terms. The Amended Page Terms for State and Local Governments in the United States is available from the Facebook Pages Terms. View the State CIO and Attorney General news release about the amended terms.

Facebook has specifically agreed to modify the provisions of its terms and conditions to:

  • Strike the indemnity clause except to the extent indemnity is allowed by a state's constitution or law;
  • Strike language requiring that legal disputes be venued in California courts and adjudicated under California law;
  • Require that a public agency include language directing consumers to its official website prominently on any Facebook page; and
  • Encourage amicable resolution between public entities and Facebook over any disputes.

The modifications immediately apply to state and local government agencies already on Facebook.

Facebook has launched its Facebook and Government page — a Facebook Page for information about how governments can best use Facebook.

Implementation Steps

  1. Before a State of Oklahoma agency may use any social media or social networking site, the agency must have such an internal social media policy developed and approved by the Office of Management and Enterprise (OMES). Create the policy and submit it to the OSF Service Desk. Guidance for creating this policy may be found in the State of Oklahoma Social Networking and Social Media Development Methodology. Before an agency may use social networking or social media technologies, OMES must approve the agency policy.
  2. Review the Facebook Terms of Service, the Facebook Pages Terms and the Amended Page Terms for State and Local Governments in the United States. The amended terms were issued in December 2010 and apply to existing and new accounts. The state has accepted the amended pages.
  3. Review the State of Oklahoma Facebook ToolKit (.pdf, 25 pp, 309 KB), which provides standards, guidance and best practices for implementing Facebook Pages.

Instructions for Removing Facebook Community Pages

Go to http://www.facebook.com/legal/copyright.php?howto_report and use the link to Facebook's "automated IP infringement form."

Please include a note that you have received communication from Facebook explaining the purpose of Community Pages and the possibility of future migration, and that you are explicitly requesting that the Community Page be removed.

In order for an agency to have its social networking or social media site linked on the State web portal, OK.gov, an agency must to sign and return a copy of the Social Networking/Social Media Agreement.
