Online Licensing and Permitting Exemption Process

  • OSF Form – Online Licensing and Permitting Exception Request

Purpose

The Oklahoma State Government Modernization Act of 2009 calls for each agency under the Executive Branch that issues licenses or permits to make application and renewal capabilities accessible through the State Web site by July 1, 2010. Specifically, it outlines how agencies must comply with the requirements of the law or request exemption of individual licenses and permits.

The purpose of this procedure is to provide a structured process for licensing agency directors to request exemption of individual licenses and permits from the requirements of the statute. It is designed to:

  • Ensure that the Director of State Finance receives compelling evidence justifying the need for exemption of an individual license or permit
  • Establish the basis for the Director of State Finance to determine whether the exemption of an individual license or permit is justified based on the evidence submitted
  • Ensure that the Director of State Finance can document and describe any exemptions issued based on the compelling evidence justifying the need for the exemptions in a report to the Governor, Speaker of the Oklahoma House of Representatives and Speaker Pro Tempore of the State Senate

Scope

This procedure applies to all licensing agency directors requesting exemption of individual licenses or permits from the requirements of the law.

It shall not apply to license renewals pursuant to the Oklahoma Vehicle License and Registration Act of Title 47 of the Oklahoma Statutes.

Definitions

License:

This term refers to a license, certificate, registration, permit, or other form of authorization, including a renewal of the authorization that a person or legal entity must obtain to practice or engage in a particular business, occupation, or profession; or to use a location for a particular purpose or activity. The use of the term “license” within this process is used as a blanket term for that includes the words “certificate”, “registration”, “permit”, or other form of authorization regardless of the word used to designate it.

Licensing Agency:

This term refers to a state agency, board, commission, or any state entity organized within the executive department of state government responsible for licensing or permitting.

Licensing Agency Director:

This term refers to the highest executive officer of an agency regardless of title.

Actions

A. Licensing Agency Directors

    • Complete the form – Online Licensing and Permitting Exemption Request, one for each individual license candidate for exemption per the form instructions.
    • Submit the completed exemption request forms to the Director of State Finance.

B. Director of State Finance

    • The Director of State Finance will respond to the requesting licensing agency director with a full disposition for each proposed license exemption within 5 business days.

Responsibilities

  • The Director of State Finance is responsible for maintaining this process.
  • Specific responsibilities are included in Section 4.
