BYLAWS STATEWIDE 9-1-1 ADVISORY BOARD
ARTICLE I ORGANIZATION
The Statewide 9-1-1 Advisory Board was created in 2005 to assist in the development and improvement of 9-1-1 service in Oklahoma. The statute creating the board is 63 O.S. (2005) sec. 2847. ARTICLE II DUTIES
The duties of the board shall be to:
1. Secure resources for the creation, operation, expansion, and cooperative undertaking of local public safety answering points;
2. Secure and direct the distribution of public funds and grants as needed;
3. Facilitate information-sharing among public safety answering points;
4. Create and maintain best practices databases for public safety answering-point operations;
5. Encourage equipment and technology sharing among small jurisdictions;
6. Take steps to expand enhanced wire-line nine-one-one service to every telephone user in the state;
7. Assist public-safety answering points in implementing Phase I and Phase II wireless technology;
8. Provide a clearinghouse of contact information for all telephone companies operating in the state and contact information and nine-one-one fees charged in each jurisdiction;
9. Develop training program standards for nine-one-one call takers;
10. Designate a Statewide Nine-One-One Coordinator; and
11. Take any steps necessary to carry out these duties.
ARTICLE III MEMBERSHIP
The board shall be composed of the following members:
1. The Statewide Nine-One-One Coordinator;
2. One member who represents the Oklahoma Chapter of the Association of Public Safety Communication Officials (APSCO) to be appointed by the President Pro Tempore of the Senate;
3. One member who represents the Oklahoma Chapter of the National Emergency Number Association (NENA) to be appointed by the Governor;
4. One member who represents the Oklahoma Municipal League (OML) to be appointed by the Speaker of the House of Representatives;
5. One member who represents the Association of County Commissioners of Oklahoma (ACCO) to be appointed by the Governor;
6. One member who represents the Oklahoma Association of Regional Councils (OARC) to be appointed by the President Pro Tempore of the Senate;
7. One member who represents the Oklahoma State Law Enforcement Communications Association (OSLECA) to be appointed by the President Pro Tempore of the Senate;
8. One member who represents a sub-state planning district as defined in Section 2843 of Title 63 of the Oklahoma Statutes to be appointed by the Governor;
9. Two members who each represent a municipal government that operates a nine-one-one system and has a population of less than one hundred thousand (100,000), one to be appointed by the Speaker of the House of Representatives and one to be appointed by the Governor;
10. One member who represents a municipal government that operates a nine-one-one system and has a population of more than one hundred thousand (100,000) but less than four hundred fifty thousand (450,000) to be appointed by the Governor;
11. One member who represents a municipal government that operates a nine-one-one system and has a population of more than four hundred fifty thousand (450,000) to be appointed by the Speaker of the House of Representatives;
12. One member who represents an organization created by an interlocal agreement for the purpose of sharing public safety answering-point duties and whose members are municipal governments with a population of less than four hundred fifty thousand (450,000) to be appointed by the Governor;
13. One member who represents an organization created by an interlocal agreement for the purpose of sharing public safety answering-point duties and whose members are municipal governments with a population of more than four hundred fifty thousand (450,000) to be appointed by the President Pro Tempore of the Senate;
14. One member who is a nine-one-one coordinator for a county with a population of less than twenty thousand (20,000), to be appointed by the Speaker of the House of Representatives;
15. One member who is a nine-one-one coordinator for a county with a population of more than twenty thousand (20,000), to be appointed by the President Pro Tempore of the Senate;
16. One member who is a nine-one-one coordinator for a county, to be appointed by the Governor;
17. One member who represents a local exchange telecommunications service provider which serves less than fifty thousand (50,000) access lines in the state or a telephone cooperative to be appointed by the President Pro Tempore of the Senate;
18. One member who represents a local exchange telecommunications service provider which serves more than fifty thousand (50,000) access lines in the state to be appointed by the Speaker of the House of Representatives;
19. One member who represents a Tier I wireless carrier, as defined by the Federal Communications Commission, to be appointed by the Speaker of the House of Representatives;
20. One member who represents a Tier II wireless carrier, as defined by the Federal Communications Commission, to be appointed by the Speaker of the House of Representatives;
21. One member who represents a Tier III wireless carrier, as defined by the Federal Communications Commission, to be appointed by the President Pro Tempore of the Senate;
22. One member who represents a public or private entity that supports nine-one-one services or public safety providers to be appointed by the Speaker of the House of Representatives; and
23. The Oklahoma Secretary of Safety and Security or a designee.
Term of Service - Each member of the board shall serve at the pleasure of the official who made the appointment. The member shall serve until such time as he or she tenders a resignation in writing to the appointing official, or until the member is removed or replaced.
Attendance - Members missing more than 3 meetings in one fiscal year without adequate explanation as determined solely by the Chair shall be deemed to have excessive absences. In the event that a member has excessive absences, the Chair shall correspond with the respective appointing authority reporting the absences.
Compensation - Board members shall receive no compensation for serving on the board but shall receive travel reimbursement by the appointing authority for travel expenses incurred in the performance of board duties in accordance with the State Travel Reimbursement Act.
ARTICLE IV OFFICERS & DUTIES The Statewide 9-1-1 Advisory Board shall have as its officers a Chair, Vice Chair and Secretary.
Chair It shall be the duty of the Chair to set the meeting schedule for each fiscal year The Chair, or his appointee, shall conduct the meetings. The Chair shall appoint all standing committee chairs who shall form, along with the Vice Chair and the Secretary, the Executive Committee.
Vice Chair The Vice Chair shall conduct the meetings in the absence of the Chair, and shall perform such other duties as may be assigned by the Chair or the board.
Secretary The Secretary shall be responsible for taking the minutes of the meeting and providing timely distribution of the minutes to the board members.
Term of Service Officers shall serve in office beginning upon the date and month that they were elected by the board and continuing for 1 year. Officers may serve in the same office for no more than 2 consecutive 1-year terms.
Election of Officers Nominations for a slate of officers shall be presented to the full board by the Nominating Committee no later than June of each calendar year, except that, in the year in which these by-laws are first adopted nominations shall be submitted at the next regular meeting after the adoption of the by-laws. Election of officers shall be conducted according to Roberts Rules of Order Newly Revised.
ARTICLE V COMMITTEES The board shall have the following standing committees:
Executive Committee – The Executive Committee shall be made up of the officers and the standing committee chairs. The purpose of the executive committee shall be to assist the Chair in the development of the agenda for the upcoming meeting, and to carry out such tasks as the Chair deems advisable, subject to the approval of the Board.
Legislative Committee – The legislative committee shall be made up of members of the Statewide 9-1-1 Advisory Board and other citizens, selected by the Board at an open meeting. The legislative committee shall propose a slate of issues for Board adoption no later than January of each calendar year.
Publicity Committee – The publicity committee shall be made up of members of the Statewide 9-1-1 Advisory Board and other citizens, selected by the Board at an open meeting. The publicity committee shall develop and maintain the Board’s website, published material, panel of volunteer speakers and such other materials and duties related to publicity of public safety and 9-1-1 issues as the Board determines.
Ad Hoc Committees Ad Hoc Committees may be established by the Chair or by the majority vote of the board at a meeting duly called at which a quorum is present. Non-members may be appointed to ad-hoc committees subject to the board’s approval. The Chair of each ad hoc committee must be a member of the board.
Nominating Committee A Nominating committee chair and members shall be appointed by the Chair no later than July of each year. The duty of the nominating committee shall be to select a slate of officers for recommendation to the board for the upcoming fiscal year.
ARTICLE VI MEETINGS All meetings shall be conducted in accordance with the Oklahoma Open Meetings Act.
Regular Meetings The board shall approve a schedule of regular meetings for the upcoming calendar year by December 15 of each year. In the event that the Board fails to approve a schedule of meetings, the Chair may file a schedule of meetings pursuant to the Open Meetings Act and submit the schedule to the Board for approval at the next regularly scheduled meeting.
Special Meetings Special Meetings may be called from time to time by the Chair or by a majority of the board present at a duly called meeting.
Quorum A quorum of the board must be present for any business to be conducted. A quorum constitutes 50 percent of the members of the board plus 1 member.
Voting Each duly appointed member of the board present at a duly called meeting shall be entitled to one vote. No proxy voting shall be allowed.
ARTICLE VII MINUTES Written proceedings of all meetings of the board shall be made and kept by the Secretary. These minutes will clearly show those members present and absent, all matters considered by the board and all actions taken by the board.
ARTICLE VIII OPERATING YEAR The operating year for the board shall be from July 1 until June 30.
ARTICLE IX AMENDMENT TO BYLAWS These bylaws may be amended by the approval of two-thirds of the board members present at a duly called meeting of the board.
ARTICLE X ADOPTION OF BYLAWS These by-laws shall become effective upon the adoption by a majority vote of the board members present at a duly called meeting of the board.
ARTICLE XI PARLIAMENTARY AUTHORITY All proceedings of the board not otherwise addressed in Oklahoma law or these by-laws shall be governed by Roberts Rules of Order, Newly Revised.
